Terms of Use


  1. Use of the website is subject to all the terms of use set forth below.
  2. This website is operated and managed by L. Raphael Ltd., owned by Ronit Raphael – Science of Beauty, Wellness and Longevity (hereinafter: "the Website Operator"), for the purpose of advertising and marketing the Website Operator's services and/or products, including through advertising entities with which the Website Operator works (hereinafter: "Advertisers").
  3. Use of the website is subject to the website user's (hereinafter: "the User") agreement to all the terms of use and privacy terms detailed below. If the User does not agree to any of the terms, they may not make any use of the website.
  4. The website's content (hereinafter: "Website Content") is all information of any kind and in any form appearing on the website, including text, images, animation, source code, design, graphic elements, and interactive components.
  5. The website is intended to be an informational/marketing website in the field of spa treatments, advanced medical and cosmetic aesthetics. The Website Content is provided as is (AS IS) and without any warranty whatsoever. The Website Content does not constitute medical advice, does not constitute a professional opinion, and is not a substitute for consultation with an expert. The User represents and confirms that they shall have no right and/or claim and/or demand whatsoever against the Website Operator, and that any use made of the website, including any reliance on the Website Content, shall be at their full and sole responsibility.
  6. Although the Website Operator works to ensure that the information appearing on the website is accurate and complete, errors may occur in what is published on the website. By browsing the website, the User acknowledges that they shall have no claims whatsoever against the Website Operator regarding errors, incorrect information, or outdated information that appeared on the website, and/or regarding any consequence caused as a result of relying on the information found on the website.
  7. The User may leave contact details in order to receive various publications and notices of promotions published on the website from time to time. Should the User agree to this option, the User undertakes to fill in only true, complete, and accurate details.
  8. The User hereby authorizes the page operator to transfer their personal details to third parties at its sole discretion. The User confirms that they shall have no claim and/or demand in connection with the transfer of their personal details as stated above. The Website Operator undertakes that the User's details will be used only for the purpose of sending updates, notices, publications, marketing information and the like via electronic or other media, including, but not limited to, SMS, MMS, WAP messages, email, and the like. At any time, the User may contact the Website Operator in writing at the email address: thejaffaspa@l-raphael.com requesting removal from the information mailing list. Information required by the operator for the management of its business - including documentation of commercial and other actions performed by the User on the website - will continue to be retained by the operator in accordance with law, but will no longer be used for the Website Operator's contact with the User.
  9. The Website Operator shall be entitled to use information received about the User for statistical purposes and to retain the information for its own needs. The Operator shall be entitled to share the information with advertising entities at its sole discretion. The Operator also reserves the right to keep a copy and/or backup of the information at its sole discretion.
  10. For the purpose of operating the website, and for the purpose of collecting information regarding the User's use of the website in order to analyze it, the website may use "cookies." These files are stored in various directories depending on the browser used by the User, such as Temporary Internet Files or the cookies directory or any other directory. These files include information and data about the User's activity on the website. Should the User wish to avoid cookie files, this can be done by configuring the blocking of cookies and/or deleting them on the User's computer at any time; however, in such a case the User may not be able to use some of the website's services.

For the avoidance of doubt, it is clarified that filling in and sending the User's details constitutes consent to the sending of advertising materials, and that filling in the User's details constitutes negotiation for the purchase of a property or service pursuant to Section 30A(c)(1) of the Communications Law (Telecommunications and Broadcasting) (Amendment No. 40), 5768-2008 .
  12. Leaving details is permitted for users over the age of 18. The Website Operator clarifies that users may not be registered for the service offered on the website without their consent and/or knowledge. In the event of registration without authorization, a request for removal from the mailing list may be submitted by email, and the Website Operator will act to remove the User from the website's mailing list no later than 72 hours from confirmation of receipt of the email.
  13. Scanning of the website's content by robots, crawlers, or spiders is permitted solely for the robots of search engine companies, and solely for the purpose of adding the website to search engine indexes. The use of robots to scan the website's content for any other purpose is prohibited, including scanning by parties that are not search engine companies. This prohibition applies to parent companies, subsidiaries, and affiliated companies of the major search engine companies.
  14. All rights, including intellectual property rights, in the Website Content are reserved to the Website Operator. For the avoidance of doubt, it is clarified that use of the website does not grant the user any right whatsoever. It is strictly prohibited to copy any part of the website for any purpose whatsoever and in any form whatsoever, technological or otherwise. This prohibition includes a prohibition on copying headlines, texts, music, melodies, audio tracks and effects, images, graphics, layout, design elements, links and source code.
  15. It is strictly prohibited to make any distortion, impairment, or other alteration of any kind to the content or any part of the website, including the presentation of any part of the content.
  16. The User agrees and declares that they have not and will not have any claim against the Website Operator in any case where the website's security is breached, in whole or in part. The User also declares and undertakes not to make any use that would harm the security and/or integrity of the Website Operator's systems, in any way whatsoever. The User gives their consent that the Website Operator, at its sole discretion, shall be entitled to take any action to protect the website, its services, and its computer systems, even if such actions may, due to technological difficulties, block or delay legitimate use of the website as well.

The User declares and agrees that there may be disruptions and/or malfunctions and/or changes to the website and/or to browsing it due to external circumstances beyond the control of the Website Operator. The Website Operator makes no representation whatsoever regarding the suitability, reliability, availability, correctness, absence of errors, or accuracy of the website and its content, for any purpose whatsoever, nor regarding the absence of viruses or other harmful components therein, or the absence of technical malfunctions on the website and/or in the operator's computer systems.

The User declares that they are aware that browsing the website and searching or advertising through it depends on technological factors not always under the control of the Website Operator, such as the availability and proper functioning of the internet and other communication networks, as well as the User's own end equipment. Accordingly, the User shall not be entitled to raise against the Website Operator any claim and/or demand and/or legal or other request regarding any loss, expense, distress, or damage of any kind whatsoever, including, but not limited to, bodily injury or loss, direct or indirect, arising from any error, malfunction, impairment of quality, or failure in the delivery of services, insofar as such error, malfunction, or failure results, directly or indirectly, from a malfunction, failure, or the like in technological factors not under the control of the Website Operator.
  19. The provisions of these terms are in addition to, and do not detract from and/or impair, any immunity, protection, limitation, and/or exemption from liability granted to the Website Operator and/or which may be granted to it in the future under any law.
  20. In any case of contradiction and/or discrepancy between the provisions of these terms and any other publications and/or representations regarding the Website Operator and/or the website, whether in writing or orally, of any kind whatsoever and from any time whatsoever, the provisions of these terms shall prevail in every respect, and it is these provisions that shall govern.
  21. Israeli law shall apply to these terms, and jurisdiction shall be vested exclusively in the courts of Tel Aviv.

  23. The Website Operator shall be entitled at any time to change the terms of use of the website without prior notice. The current version appearing on the website shall prevail over any previous version.

  25. Limitation of Liability
  26. Nothing stated on this website shall be regarded as personal advice or any other type of advice; for that purpose, the User should consult an appropriate professional in order to receive suitable and concrete advice. It is clarified and agreed in advance that the User's use of the website does not create between the parties any legal relationship whatsoever, including that of advisor, contractor, service provider, or the like, and that there is no legal obligation whatsoever toward the user. It is hereby clarified that, notwithstanding anything stated in any publication, advisory conversation, rumor, appearance, or the like, whether regarding the Website Content or regarding physical use of it, the User hereby declares that neither they nor anyone on their behalf has or will have any claim and/or demand and/or lawsuit against the Website Operator and/or anyone on its behalf.
  27. The User gives their consent to the Website Operator to transfer their personal details to advertising entities, for the purpose of contact by email or telephone, at the sole discretion of the Website Operator. The User agrees and hereby confirms that they shall have no claim and/or demand in connection with the transfer of their personal details as stated above.
  28. In any case of a user being registered without authorization, or for the purpose of updating personal details, the User may contact the Website Operator and request removal from the mailing list or an update of their details, via email, and the page operator will act to remove the User from the mailing list within 72 hours from the time confirmation of receipt of the email is received.
  29. Update of the Terms – The website operator may update these terms from time to time, at its sole discretion and as it deems appropriate. The binding version of the terms shall be the one published on the website at the time relevant to the User's use of the website.
  30. Booking Treatments - Booking treatments is subject to the availability of therapists, rooms, and equipment required to perform the treatments. Completing an order on the website constitutes a request for booking, and final confirmation will only be given when the User is sent an official confirmation of the booking from the Website Operator.
  31. Performing Treatments at the Spa – it is clarified that the performance of treatments is subject to all procedures in effect at the spa, which may change from time to time. This includes the requirement that the performance of treatments is also subject to a full and accurate health declaration by the client, and compliance with the spa's rules of conduct and use of its facilities.
  32. Changes / Cancellations of Treatment Bookings – Cancellation without charge is possible up to 48 hours before the scheduled treatment time. Cancellation within less than 48 hours before the scheduled treatment time will result in a full charge with no refund possible. Rescheduling of the treatment will be possible subject to availability.
  33. Gift Cards and Treatment Vouchers (hereinafter jointly: "Vouchers") – Vouchers may be purchased on the website and shall be valid for two years from the date of purchase, unless otherwise agreed in writing. The voucher must be presented prior to redemption. Scheduling an appointment to redeem the vouchers will be done in accordance with the terms set out above regarding the booking of treatments.
  34. Jurisdiction and Dispute Resolution – In any case a dispute arises regarding the website, its content, and/or the service provided by virtue thereof, the User agrees in advance that it shall be brought before and conducted in the competent court of the Tel Aviv-Jaffa district.
